Terms of Service & SMS Terms

These terms govern use of the Safer Highways Inc compliance portal at saferconnected.com (the "Service") and the Safer Highways Inc Compliance Notifications text-messaging program. By using the Service or receiving our messages you agree to these terms.
The Service
The Service is provided to commercial motor carriers ("clients") and their authorized users to manage DOT compliance records. Clients are responsible for the accuracy of information they enter and for having appropriate authority and consent to enter information about their drivers, including mobile phone numbers. The Service assists with recordkeeping and does not replace the carrier's own obligations under the Federal Motor Carrier Safety Regulations.
SMS / text-messaging program terms
Program name: Safer Highways Inc Compliance Notifications.
Program description: Transactional account notifications sent to enrolled drivers and carrier safety contacts: requests to upload an expiring DOT document with a secure link, a follow-up reminder if the document is not received, requests to electronically sign a compliance document, and alerts when a driver or vehicle document is within 7 days of expiring. No marketing messages are sent.
How to opt in: Drivers are enrolled by their employer in the portal, where the employer confirms the driver has agreed to receive compliance texts. Carrier contacts opt in by enabling "Expiration text alerts" and entering their mobile number in their portal profile. Consent to receive texts is not a condition of any purchase.
Message frequency: Varies based on your compliance activity; typically fewer than 10 messages per month.
Message and data rates may apply. Check with your wireless carrier for details of your plan.
How to opt out: Reply STOP to any message to cancel. You will receive one confirmation text and no further messages. Reply START to re-subscribe.

Supported carriers: Major U.S. carriers including AT&T, T-Mobile, Verizon and others. Carriers are not liable for delayed or undelivered messages.

Electronic signatures
By signing a document through the Service you agree that your electronic signature is the legal equivalent of your handwritten signature under the U.S. ESIGN Act, and you consent to our recording the date, time, IP address and contact details used, which are attached to the signed document as a signature certificate.
Acceptable use and disclaimer
You may not use the Service to upload unlawful content, to access records of a company you are not authorized for, or to interfere with the Service. The Service is provided "as is"; Safer Highways Inc is not liable for indirect or consequential damages, and our total liability is limited to fees paid for the Service in the preceding twelve months. These terms are governed by the laws of the State of North Carolina.
